Terms of Service

This is the agreement between TapBerry ("we") and the business that subscribes to the service ("you", "the shop"). It covers what we provide, what it costs, who owns what, and how either of us can end it. Your customers do not agree to this — they agree to the loyalty programme terms, which are separate.

1. What we provide

TapBerry gives your shop a branded digital loyalty card that your customers add to Apple Wallet or Google Wallet, a scanner your staff use at the counter, a dashboard where you see what is happening, and the ability to send messages to card holders.

Setup is done for you. We build the card, print the counter stand, and install the scanner on a phone in your shop. If something needs changing later, you can change it yourself or ask us.

Apple Wallet and Google Wallet are not ours. We generate and sign passes for those platforms under our own developer credentials. Apple and Google can change their platforms, and if they do, we adapt as fast as we can — but we cannot promise a wallet feature we do not control.

2. Fees and billing

The subscription is AED 149 per shop per month, plus a one-off setup fee of AED 50 that covers building the card and printing the first counter stand. Prices are quoted exclusive of VAT, which is added where it applies.

There is no fee per customer, per stamp, per message or per wallet pass. A shop with fifty members and a shop with five thousand pay the same.

Billing is monthly in advance by card, handled by Stripe. Full detail — renewal dates, failed payments, refunds and cancellation — is in Billing, Refunds & Cancellation.

3. What you agree to do

  • Honour the rewards on your own card. The card is a promise your shop made; we only keep count.
  • Tell customers what they are joining before they join, and do not join anyone without them asking.
  • Keep staff PINs to the staff they belong to, and deactivate anyone who leaves. You are responsible for what is done under your shop's account.
  • Use messaging within the caps and the rules in the Acceptable Use Policy. The wallet pass sits on a customer's lock screen, and abusing that is the fastest way to lose the channel for everyone.
  • Keep the details you give us accurate — the trade name, the address, the phone.

4. Who owns the data

Your customer list is yours. The names, phone numbers, balances and visit history belong to your shop. We hold them to run the service, and we act as a processor on your instructions for that data. We do not sell it, we do not rent it, and we do not use one shop's customers to market to another shop.

You can export it at any time while your subscription is active, and for thirty days after it ends. How personal data is handled in detail is in the Privacy Policy, and the third parties involved are listed in Sub-processors.

Aggregate, non-identifying statistics — how many shops use stamp cards versus points, how often cards get scanned — remain ours and may be used to improve or describe the service. Nothing in that aggregate identifies a shop or a person.

5. Availability and what happens when things break

We aim to keep the service running at all times and we monitor it. We do not offer a contractual uptime guarantee at this price, and we will not pretend otherwise.

The counter scanner keeps working without internet: stamps queue on the device and sync when the connection returns. Balances are recorded as an append-only ledger, so a stamp that was given is not lost by a later failure.

If we cause a loss of data, we restore from backup. If we cannot restore it, tell us and we will credit the affected months.

6. Ending the agreement

You can cancel at any time, effective at the end of the month you have paid for. There is no notice period and no cancellation fee.

We may suspend the service if a payment fails and stays unpaid past the 7-day grace period, or immediately if the account is being used in a way that breaks the Acceptable Use Policy or the law. Suspension pauses scanning and card updates; it does not delete balances.

When an account ends, we send one final message to card holders telling them the programme has ended, so nobody is left holding a card they think still works. Customer data is deleted ninety days after the account closes unless you ask for it sooner.

7. Liability

Neither side excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded under UAE law.

Beyond that, our total liability in any twelve-month period is limited to the fees you paid us in that period. We are not liable for lost profits, lost business or the value of rewards you chose to honour.

8. Changes to these terms

We will give at least thirty days' notice by email before any change that materially affects you, including a price change. If you do not accept it, cancel before it takes effect and you will not be charged the new price.

9. Governing law

These terms are governed by the laws of Dubai, United Arab Emirates, and the courts of Dubai, United Arab Emirates have exclusive jurisdiction.
